For a foreign professional to work in Spain, it is necessary to have a permit that allows it, but it doesn’t always have to be a residence and work permit.

Residence Permits Without Work

There are several permits that are not expressly granted for engaging in work activities, but they still allow working legally.

The residence permits without work are as follows:

  1. Residence Permit for Family Reunification for the Spouse or Domestic Partner: The holder of this permit is authorized to work without any additional administrative procedures, whether as an employee or self-employed, anywhere in Spain. However, if the activity is sustained over time and the salary exceeds the Minimum Interprofessional Wage, the holder must apply for an individual permit.
  2. Residence Permit for Family Reunification for Descendants: As long as the holder meets the age requirements, they can work as an employee or self-employed, anywhere in Spain, without any administrative procedures. This type of permit is not unlimited in duration, so it is advisable for the child to apply for an individual permit once their professional activity becomes substantial and economically independent.
  3. Residence Permit for Family Members of EU Citizens for Spouse or Domestic Partner: Holders of this permit can engage in any activity, whether as an employee or self-employed, except for jobs reserved for EU citizens.
  4. Residence Permit for Family Members of EU Citizens for Descendants and Ascendants: Children over 21 years old and parents dependent on the EU citizen cannot work if such work results in losing their dependent status. They can only work when the income obtained is not necessary for their support, and the full-time contract does not exceed three months annually nor shows continuity in the labor market.
  5. Student Permit for Specialization in the Health Sector: Foreigners with a Spanish degree or a recognized/homologated foreign degree in medicine, pharmacy, nursing, or other fields accessing specialized health training positions can perform the special work activities for the residency of specialists in Health Sciences without work authorization. In these cases, the competent Immigration Office must be notified.
