In November 2024, the Royal Decree 1155/2024 was published, introducing significant changes to the Regulation of the Organic Law 4/2000 on the rights and freedoms of foreigners in Spain. Five new regularization pathways

  3. Second-chance regularization (new): An innovative pathway for individuals who were unable to renew their previous authorization.
  4. Sociolaboral regularization: For those with a valid employment contract.
  5. Socioeducational regularization: Previously known as educational regularization, this promotes vocational training as a tool for integration.

Key changes in the process

The new regulation makes regularization easier with key measures:

  • Reduction of the residency requirement: Now it is enough to have lived in Spain for two years instead of three.
  • Relaxation of requirements: More options and opportunities to meet the criteria for regularization.
  • Immediate work authorization: For both self-employment and salaried work from the outset.
  • Duration of authorizations:
    • Family regularization: Up to five years.
    • Other pathways: One year renewable.

The second-chance regularization is particularly relevant, as it allows individuals who had residency authorization in the last two years but couldn’t renew it to regularize their status.
